Firefox Home Saves The Day! Video Challenge Rules

Introduction: The objective of this Challenge is to have community members produce a video that highlights how Firefox Home’s “on the go” features can save the user’s day. The video will become the next installment of the Firefox Home short videos and will be featured on the Firefox Home website. It may also be used in other promotional efforts.

Sponsor:  The sponsor of this Challenge is Mozilla Corporation, located at 650 Castro Street, Suite 300, Mountain View, CA 94041 (“Sponsor”). 

Eligibility:  No purchase or fee is necessary to enter or claim prize.   The Challenge is open to individuals who are at least the age of majority in their country of residence. Minors 13 years or older who reside in the U.S. (or 16 or 17 years old who reside in Brazil) are also eligible to participate in the Challenge but will be required to submit a signed parental consent form with their Entry. Email us at clooney at Mozilla dot com for a parental consent form.  The Challenge is open only to individuals or groups of individuals. The Challenge is not open to companies, educational institutions, organizations, etc. or to groups associated with such institutions. Entrant may not enter any video in which such institution may claim ownership.  The Challenge is void in Cuba, Iran, Province of Quebec (Canada), North Korea, Sudan, Syria, Union of Myanmar, and where prohibited by law or restricted by law or regulations.

Employees of Sponsor and its parent company, subsidiaries, affiliates, suppliers, advertising agencies, and the families and persons living in the same household as such employees, are not eligible to participate. The Challenge is subject to all applicable laws.

How to Enter: To enter the Challenge, host your video (“Entry”) to any web service of your choosing (e.g. Youtube, Vimeo, Hulu, etc) and then go to www.firefoxhomesavestheday.mirocommunity.org (the "Entry Page") and enter the URL of your video and other information requested on the Entry Page (“Entry”) by clicking "Submit". You may submit as many Entries as you want.

If you are a group of individuals submitting an Entry (a “team”), the Entry shall be submitted under one individual’s email account. The names of all the individuals in the group should be noted in the description for proper attribution.

You must be the named and authorized account holder of the email address submitted in connection with your Entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider, or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. Entries submitted will not be returned or acknowledged.

Without limiting any representations or warranties, the Sponsor has the right (though not the obligation) to, in the Sponsor's sole discretion, reject or removbe from the Sponsor's websites, servers and computer systems any Entry that, in the Sponsor's sole discretion, violates these Rules, any applicable Sponsor policy, any applicable laws, or is in any way harmful or objectionable. Sponsor also reserves the right to disqualify any entrant or Entry at the Sponsor's sole discretion. No correspondence shall be entered into.

Privacy: Entrants will be asked to provide an email address so they can be contacted if selected a winner. Winners will be asked to provide a name and mailing address so that we can send the winners their prizes. All Entries may be made public, but except as otherwise stated herein or as otherwise agreed by you and the Sponsor, all personal information you provide in connection with the Challenge will be used only for purposes relating to this Challenge, and will not be communicated to third-parties without prior permission. Challenge Period:  The Challenge begins at 12:01 a.m. Pacific Standard Time (PST) (8:01 a.m. GMT) on August 15, 2010 and ends at 11:59 p.m. PST on September 12, 2010 (7:59 a.m. GMT on September 13, 2010) (the “Challenge Period”). 

Prizes: One (1) winner (an individual or team) will receive one or more iPod Touches. If a team is the winner, Mozilla will provide one iPod Touch per team member up to five. The approximate retail value of the prize is $200 per iPod Touch, up to $1,000 total. Winners are solely responsible for the payment of all federal, state and local taxes and all other expenses or costs relating to the prize not expressly set forth above. Prizes cannot be transferred or substituted and must be accepted as awarded. Sponsor reserves the right to substitute a prize of equal or greater value in its sole discretion. Please allow 8-10 weeks for prize delivery.

Work Criteria: All Entries must meet specific criteria to be accepted into the Challenge. (a) The Entry must represent Mozilla and Firefox Home in an appropriate and professional manner consistent with Mozilla's brand image. (b) The Entry must be submitted under the Creative Commons Attribution-Share Alike 3.0 License. (c) The Entry must be your original work and may not include any unauthorized intellectual property of a third party (such as a video clip, music, or visible brand name or logo you do not have a license to use). (d) You may use the graphics and logos supplied by Sponsor subject to the Mozilla Trademark Policy and Visual Identity Guidelines, available at http://www.mozilla.org/foundation/trademarks/. Mozilla retains all ownership in such graphics and logos. (e) The Entry may be no longer than one minute. (f) Non-English language videos must have English subtitles included. (g) The description of the Entry included in your submission must be clear and accurate. (h) The Entry must not be obscene, libelous, or defamatory, violate the right of privacy or publicity of any third party, or violate any applicable laws, and must comply with Mozilla’s legal notices and policies. (i) If anyone not on the submitting team appears in the video, you must obtain their explicit permission to videotape them, to enter the video in this Challenge, and to give Mozilla the right to freely use and distribute the video.

Selection of Winner: After the Challenge Period has ended, all Entries will be reviewed and judged by an internal panel of qualified judges at Mozilla, who will select the winner. Entries will be judged based on the following five criteria: Effectiveness at communicating the key themes outlined in the creative brief (25%), creativity/cleverness/inventiveness (25%), adherence to the creative brief (25%), production quality (15%), and public response (number of Likes, Tweets, views, positive comments) (10%). The decisions of the judging panel are final on all matters relating to the Challenge and no correspondence will be entered into. The winner will be notified by email on or about September 15, 2010. If a winner cannot be notified within five (5) days after his or her selection, or it is discovered the entrant or Entry violated these rules in any way, the prize will be forfeited, and the entrant having the next highest score will be deemed the winner.

Authorization to Use Winner’s Entry & Name: Accepting the prize constitutes permission for the Sponsor to make public and otherwise use your Entry, name, voice, picture, likeness, opinions, biographical information, and city and country of residence without further compensation in any media now known or hereafter developed for promotional and/or publicity purposes, unless prohibited by law. Each winner also agrees to participate in and cooperate with any promotional activity and/or publicity relating to the Challenge as the Sponsor shall reasonably request from time to time.

Release of Liability: By participating, you release the Sponsor and its subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, and all others associated with the development and execution of this Challenge, from and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Challenge and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and you agree that these entities are in no way responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the Challenge and/or the awarding of any prize.

For the avoidance of doubt, to the extent that English law applies, nothing in these Rules shall limit or exclude either party's liability for fraud, or for death or personal injury caused by its negligence, or any other liability to the extent such liability cannot be excluded or limited as a matter of law.

You also agree to hold harmless Sponsor, its officers, directors, employees, divisions, affiliates, subsidiaries, and advertising and promotional agencies, from any claim by any third party relating to any rights in the Entry you submitted. 


Representations and Warranties:  By entering, you (meaning each member of a team if a team is submitting the Entry) warrant and represent that (a) you are the sole and exclusive owner or authorized licensee (and free of any adverse claim by any person, firm, or corporation) of all intellectual property rights in and to the Entry (exclusive of Mozilla’s intellectual property rights); (b) the Entry is original and the use of the Entry as described in these Rules will not infringe the proprietary rights, including without limitation the intellectual property rights, of any third party; (c) the use of the Entry, as described in these Rules, will be in compliance with any third-party licenses pertaining to the Entry; (d) the Entry is not obscene, libelous, defamatory and does not violate any rights of any third party, including but not limited to rights of privacy or publicity; (e) the Entry does not target anyone because of his or her membership in a certain social group, including race, gender, color, religion, belief, sexual orientation, disability, ethnicity, nationality, age, gender identity, or political affiliation, and does not contain a symbolic representation of any group that targets anyone because of his or her membership in a certain social group; (f) you have accurately categorized and described the type and nature of the Entry on the Entry Page; (g) the Entry does not contain any virus, spyware, malware, trap door, worm, or any other device, mechanism or code that is injurious or damaging to software or hardware used in conjunction with the Entry; (h) the Entry and its use as described in these Rules will not violate any federal, provincial, state or local laws or ordinances; (i) no employer or educational or other establishment has any rights in the Entry; (j) the Entry is consistent with these Rules; and (k) you have the right to grant to Sponsor and its designees the license granted below. By entering you agree to be bound by these Rules, including all eligibility requirements and all decisions of Sponsor, which are final and binding in all matters relating to the Challenge. 

Intellectual Property:  Any Entry entered in this Challenge shall remain the exclusive property of the entrant and entrant's licensors. By participating in the Challenge and in addition to any license governing the Entry (even if an open source license), the entrant grants to Sponsor and its designees a nonexclusive, irrevocable, sublicensable, unconditional, transferable, worldwide royalty-free license to use, reproduce, encode, store, modify, transmit, publish, post, copy, adapt, distribute, publicly display, publicly perform, and create derivative works and screen shots of the Entry. In the case of Entrants who are Australian residents, Entrants consent to the Sponsor doing or omitting to do any act which may otherwise infringe the Entrant’s moral rights (as defined in the Copyright Act 1968 (Cth)). 

Mozilla’s Trademarks:  The names Mozilla, Firefox, Thunderbird, Bugzilla and XUL, as well as the Mozilla logo, Firefox logo, Thunderbird logo and the red lizard logo are all registered trademarks of the Mozilla Foundation in the U.S. and several other countries. Any use of those or any other Sponsor (or Mozilla Foundation) trademark, trade name or logo must comply with the Mozilla Trademark Policies as posted at http://www.mozilla.org/foundation/trademarks/

Disclaimers:  Sponsor is not responsible for: (i) lost, late, misdirected, damaged, garbled or illegible entries; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Challenge.  Sponsor reserves the right to: (i) permanently disqualify from any Challenge it sponsors any person it believes has intentionally violated these official rules; and (ii) suspend, modify or terminate the Challenge if Sponsor believes, in its sole discretion, that malfunction, error, disruption or damage is impairing or will impair the administration, security, fairness, or integrity of the Challenge. If the Challenge is terminated before the scheduled end of the Challenge Period, the Sponsor will determine the winner from all eligible entries received as of the termination date. Persons found tampering with or abusing any aspect of the Challenge, or whom the Sponsor believes to be causing or attempting or intending to cause any malfunction, error, disruption, or damage will be disqualified. The Sponsor reserves the right to disqualify any unauthorized entries, including, without limitation, any entries made through robotic, automatic, mechanical, programmed or similar multiple-entry, or entry duplication, method and to disqualify any person or entity using such a method.

Winner’s Name: For the names of the winners and/or the judges send a self-addressed, stamped envelope to "FIREFOX HOME SAVES THE DAY CHALLENGE Winner List", attn: Mobile, 650 Castro Street, Suite 300, Mountain View, CA 94041. Requests must be received (not just postmarked) by December 31, 2010.
